• The Platform is directed to be used by adults only and to persons who can enter into legally binding contracts under applicable law. We assume that any minor, if at all, accessing the Platform is under the supervision of their guardians. GenSxty Tribe Pvt. Ltd or its associates do not knowingly collect information from minors. You will be responsible for maintaining the confidentiality of your account, password, and restricting access to your computer, and you hereby accept responsibility for all activities that occur under your account and password. You acknowledge that the information you provide, in any manner whatsoever, is not confidential or proprietary and does not infringe any rights of a third-party.

•          If you are accessing, browsing and using the Platform on someone else’s behalf; you represent that you have the authority to bind that person to all the terms and   conditions herein. In the event that the person refuses to be bound as the principal to the Terms of Use, you agree to accept liability for any harm caused by any wrongful use of the Platform resulting from such access or use of the Platform.

• If you know or have reasons to believe that the security of your account has been breached, you should contact us immediately at the ‘Contact Information’ provided below. If we have found a breach or suspected breach of the security of your account, we may require you to change your password, or suspend your account without any liability to GenSxty Tribe Pvt. Ltd.

• We reserve the right to refuse service and/or terminate accounts without prior notice if these Terms of Use are violated or if we decide, in our sole discretion, that it would be in GenSxty Tribe Pvt. Ltd’s best interests to do so. You are solely responsible for all content that you upload, post, email or otherwise transmit via the Platform. The information provided to us shall be maintained by us in accordance with our Privacy Policy. 

• Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform.

The user shall not use the Platform for any of the following purposes:

• Circulating any unlawful, harassing, abusive, obscene or otherwise objectionable material.
• Gaining unauthorized access to other computer system interfering with any other person’s use or enjoyment of the Platform.
• Breaching any laws concerning the use of public telecommunications networks or systems.
• Interfering or disrupting networks or other websites connected to the Platform.
• Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

The Services provided by GenSxty on the Platform are only available to subscribed users. The user will be required to pay the yearly subscription fee to utilize any of the services on the platform. A user is required to furnish their personal information as per the terms of the Privacy Policy to avail the services of at the Platform. The yearly subscription is non-refundable.

Upon registering on the Platform there are three categories of user modes available on the Platform:

•     Registered User: A user who logs in/signs up after providing the basic required personal details including but not limited to name, mobile number and email address.

• Subscribed User: A Registered User who pays the subscription for the Services and has full access to the Platform depending on the level of subscription. Subscription paid is non-refundable.

• Gifting Membership: As a Registered User you can also gift a membership to another individual. Subscription paid is non-refundable.

For the payment of the said subscription fee you are required to provide your financial data like payment details. This data is encrypted with the payment gateway service provider. The Access is limited to contact details, payment mode, and not details like the full card used and CVV number. That information is only with the payment gateway, which is covered by RBI and financial regulators). As a user, if you object to the User’s Information being transferred or used in this way please do not use our Website or any other Digital Platform managed by GenSxty.

As a user, you acknowledge that your use of the Platform and its services is solely at your own complete risk, and that you assume full responsibility for all risks associated therewith.

To the extent that any of the content included on the Platform is provided by third party content providers or other users. All information, services contained on or provided through the Platform is provided “as is”, without any warranty of any kind, express or implied, to the fullest extent permissible under applicable law and its Affiliates hereby disclaim all representations and warranties, express or implied, statutory or otherwise.

You understand that the information and opinions in the third-party content represent solely the thoughts of the service provider and not GenSxty Tribe Pvt. Ltd. and its Platform. However, GenSxty Tribe Pvt. Ltd. attempts to be as accurate as possible in the description of products and services on the Platform.

That GenSxty Tribe Pvt. Ltd. strives to ensure that all its services are provided without interruption. However, you acknowledge and agree that temporary interruptions in service may occur, and that the Platform shall have no liability for any claim, cost, charge, loss or expense arising from or relating to use of the Services. The Platform makes no warranty that the Services will meet your requirements, or that the Service(s) will be uninterrupted, timely, secure, or error free. The user acknowledges and agrees that in the event of failure, restoration of service may take several days.

We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Platform (or any part of it) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

We take all the necessary precautions and steps to ensure that the Platform will be error-free, free of viruses or other harmful components, or other defects. However, we do not warrant or represent that the information available on or through the Platform will be correct, accurate, timely, or otherwise reliable. We are regularly making improvements and/or changes to its features, functionality or content of the Platform at any time.

GenSxty Tribe Pvt. Ltd. expressly reserves all intellectual property rights in all text, images, programs, products, processes, technology, content and other materials, which appear on this Website. Access to this Website does not confer and shall not be considered as conferring upon anyone any license under any of GenSxty Tribe Pvt. Ltd’s intellectual property rights. All rights, including copyright, in this website are owned by or licensed to GenSxty Tribe Pvt. Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of GenSxty Tribe Pvt. Ltd.

“Force Majeure” means any unforeseeable circumstance which is beyond the control of a Party, or any unavoidable event, even if foreseeable, as a result of which such Party is unable to perform its obligations, in whole or in part, under these Terms. Such circumstances include, but are not limited to acts of God, war, riot, embargoes, acts of civil or military authorities, acts of terrorism or sabotage, electronic viruses, worms or corrupting microcode, fire, flood, earthquake, accident, strikes, radiation, inability to secure transportation, failure of communications or electrical lines, facilities, fuel, energy, labour or materials or any other similar event.

That GenSxty Tribe Pvt. Ltd. agrees to resume the performance of its Platform as soon as reasonably practicable after the remediation or removal of the cause.

Please note, if any dispute or difference(s) of any kind whatsoever shall arise between the parties hereto in connection with or arising out of this agreement the parties hereto shall in good faith negotiate with a view to arriving at an amicable resolution and settlement.

Any/all legal proceedings with regard to any matter, claim, differences and disputes arising out of this agreement, will be governed by the Indian laws and the Courts of Mumbai, Maharashtra, shall have exclusive jurisdiction over any claim arising out of it.

You acknowledge and hereby agree to these Terms and Conditions and that it constitute the complete and exclusive agreement between us concerning your use of the platform, and supersede and govern all prior proposals, agreements, or other communications.

We reserve the right, in our sole discretion, to change/ alter/ modify these Terms and Conditions at any time by posting the changes on the Site. Any changes are effective immediately upon posting to the Platform. Your continued use of the Site thereafter constitutes your agreement to all such changed Terms and Conditions. We may, with or without prior notice, terminate any of the rights granted by these Terms and Conditions. You shall comply immediately with any termination or other notice, including, as applicable, by ceasing all use of the Platform. Nothing contained in these Terms and Conditions shall be construed as creating any agency, partnership, or other form of joint enterprise between us.

• A subscribed member can cancel any availed service at any time with a 30-day notice.
• Cancellation of services where the payment has been made directly to the service provider will be subject to the respective service provider’s terms and conditions and refund policy (As a subscriber you are requested to carefully read the terms and conditions and refund policy of the service provider before availing their services).
• GenSxty Tribe Pvt. Ltd. is not responsible to ensure refunds by third party partners/service providers.

• A subscribed member is eligible for a full refund less GST and taxes up to 4 times in a year (due to health, medical and social exigencies) provided that the cancellation is received 48 hours before the scheduled event.
• The member needs to provide a reason for the cancellation.
• In case the member has already exercised 4 cancellations during the year, they will not be able to cancel any more events and no refund can be provided.
• The refund shall be credited only to the original mode of payment. The refund will be paid within 30 to 45 days from the date of cancellation by the member.
